Import and Export of Toxic Chemicals

CRC of SEPA is the authorized agency to implement the "Regulations for Environmental Management on the First Import of Chemicals and the Import and Export of Toxic Chemicals" (receive and proofread applications materials). Companies which deal with import and/or export of toxic chemicals in the "List of toxic chemicals severely restricted to be import in or export from People Republic of China" may need to register with CRC and apply for the relevant certificate or custom clearance notification. Please refer to the following guideline when applying for Clearance Notification and/or Registration Certificate.

 

1> Management on toxic chemicals import and export & Registration categories

1.  Foreign companies which export toxic chemicals to China will need to apply for Registration Certificate for Environmental Management on the Import of Toxic Chemicals (hereinafter referred to as Registration Certificate). One Registration Certificate is issued for only one type of toxic chemical, to only one foreign company with only one China domestic company as its trade associator; and Registration Certificate is issued with a quantity limit and with a valid period of two years.

 

2. For every batch of goods introduced to China, importer (China domestic company) shell apply for Clearance Notification of Environmental Management on Import of Toxic Chemicals (hereinafter referred to as Import Clearance Notification), by providing a copy of Registration Certificate obtained from its contract partner, i.e. a foreign company which exports goods to China. This document is checked on custom clearance procedures, as its name indicates.

 

3.  China domestic companies, when exporting every batch of goods of toxic chemicals shell provide the Clearance Notification of Environmental Management on Export of Toxic Chemicals, i.e. Export Clearance Notification, to pass through China custom.

 

2> How to apply for a Registration Certificate

 

1. Please submit following materials:

(1) Application form (completed in its entirety and signed properly);

(2) Business contract or agreement (reflecting two years' trade information)

(3) Duplicate copy of Verification of Import/Export Right

 

2, Registration fee $10,000 per certificate, equivalent RMB is acceptable.

 

3. Within 5 days on receipt of the application and applied fee, application materials will be read through and checked for completeness and correctness. A reference number will be allocated for each application and preliminary feedback will be given on CRC website. Send further documents if your application materials were uncompleted. Otherwise, the application for registration is considered and shown as in processing. If you have any questions, please contact us by quoting the Reference No..

 

4. CRC will consider each registration application and give basic processing opinion to SEPA. Once the application is approved by SEPA, "Registration Certificate" is issued by SEPA and distributed by CRC. Otherwise, the applicants will be duly notified by CRC if the application is denied. The whole processing period is within 30 work days on the arrival of the completed application materials.

 

3> How to apply for a Import Clearance Notification

 

1. Following materials are needed:

(1) Application form completed in its entirety; company seal utilized properly (on Item 1); and signed properly (on Item 3);

 

(2) Duplicate copy of "Registration certificate of environmental management of toxic chemicals" which is obtained from the foreign business partner;

 

(3) Original contract for every batch of goods; (There may be only one integral contract for several batches of Toxic Chemicals, thus One Application Form should be submitted to apply for a number of Clearance Notifications. However, one Clearance is issued for only one batch of goods. Please see Instruction on "How to apply for Multiple Clearance Notifications with One Application Form".)

 

(4) Document form to give information of downstream user;

 

(5) Verification of Import/Export Right, see Instruction section for more details;

Once the application is accepted and approved by SEPA, "Import Clearance Notification" is issued by SEPA and ready to collect in CRC. Otherwise, the applicants will be duly notified by CRC if the application is denied. The whole processing time is within 20 days on the receipt of completed application materials.

 

4>How to apply for a Export Clearance Notification

1. Following materials are needed:

 

(1) Application form completed in its entirety; company seal utilized properly (on Item 1); and signed (on Item 3);

(2) Original contract for every batch of goods; There may be only one integral contract for several batches of Toxic Chemicals, thus One Application Form should be submitted to apply for a number of Clearance Notifications. However, one Clearance is issued for only one batch of goods. Please see Instruction on "How to apply for Multiple Clearance Notifications with One Application Form".

(3) Documents form to give source information of Toxic Chemicals;

(4) Verification of Import/Export Right, see Instruction section for more details;

 

2. For some Toxic chemicals: Arsenic and its compound products; Sodium cyanide; and Mercury and it compound products, etc., special rules are applied.

 

Rule (1): The supplier of Arsenic and its compound products should have been approved by local Environmental Protection Bureau to produce these products. Both the supplied company and the applicant company need to stamp official seals on "Documents form to give source information of Toxic Chemicals" mentioned above.

 

Rule (2): For DDT, Hexachlorobenzene, Sodium cyanide, Tetramethyllead, Tetraethyllead, Pentachlorophenol, Chlordane, Oxirane, and Hexachlorocycloh (BHC), Rule (1) is also applied. Pursuant to the "Prior Informed Consent (PIC) procedure", a "Response Letter" from the import country's designed national authority (DNA) is compulsory for the application.

 

Rule (3): Rule (1), (2) are also applied to Mercury and its compound products. In addition, applicant should provide an "Opinion Letter" issued by local Environmental Protection Bureau.

 

3. Within 5 days on receipt of the application, materials will be read through and checked for completeness and correctness. A reference number will be allocated for each application; and preliminary feedback will be given on CRC website. Send further documents if your application materials were uncompleted. Once the application is accepted and approved by SEPA, "Export Clearance Notification" is issued by SEPA and ready to collect in CRC. Otherwise, the applicants will be duly notified by CRC if the application is denied. The whole processing time is within 20 days on the receipt of completed application materials.

 

5> Variation of "Registration Certificate"

If official name of either the exporter or the importer have been changed, an application letter should be submitted to re-issue the "Registration Certification". Following documents are needed:

1.  Application letter of alteration of company's name (properly signed or sealed by export company, i.e. foreign company; sealed by import company, i.e. China company);

 

2, A formal document issued by industrial and commerce administration to verify this name variation of the applicant;

 

3, Duplicate copy of Business License after the enterprise's name has been alternated

 

4, Original copy of "Registration Certification"

 

6> Other

 

1. For application of Registration Certificate, the whole processing time is within 30 days on the receipt of completed application materials. For application of Clearance Notification, it is 20 days.

 

2. The valid period of Registration Certificate is two years; and that of Clearance Notification is six months. And the valid period of Clearance Notification is taken into consideration to issue the formal period of an Import Clearance Notification. That is, the valid period eventually given to an Import Notification will not exceed that of the concerned Registration Certificate.

 

3. "Clearance Notification of Environment Management on Import of Toxic Chemicals" and "Clearance Notification of Environment Management on Export of Toxic Chemicals" both contain two portions (two separated pages). SEPA keeps the first portion for backup; applicant provides the second portion to customs for check up during custom clearance procedure; the customs will keep this potion and send feedback information to CRC-SEPA.

 

4. Whether or not the application of registration is passed, CRC will keep all the application materials (application form, verification documents, and processing opinion etc.) for record.

 

5. Please fill in all application forms by computer input except items of signature are required to fill in by handwriting. Please use Chinese except information of foreign companies can be provided using English. Please prepare and print all materials with A4 paper.

 

6. One application form can be used to apply for multiple Clearance Notification which involving batch of goods. However, this is only applied for a single Toxic Chemical. For example, if there are TWO Toxic Chemicals to be exported from China, please use (at least) TWO application form.
